Date set for the banks to appeal at The House of Lords.

The banks have been back in court to launch their appeal against the previous ruling in February when the High Court found in favour of the Office of Fair Trading (OFT) by announcing it can assess bank charges for fairness.

The hearing at the House of Lords lasted 3 days.

In July 2007 a waiver was issued by the City regulator, the Financial Services Authority, to allow the banks, the Financial Ombudsman Service, FOS, and the courts to suspend all bank charges claims once it was declared that a test case would take place. Many suspect that this waiver will stay in place until the conclusion of the case.

Most of the banks that have appealed against the OFT's right to assess charges for fairness have been saved by you and I the tax payer! They are RBS/NatWest, Lloyds TSB (Now Lloyds Banking Group) and HBOS. They would not be around if it were not for our support.

Hi Harry

Go to the home page and then see to the right, neae the bottom, the link for 'reclaiming charges' which is under USEFUL LINKS.

We cover everything here plus the template letters. To use the 'Personal reclaiming bank charges tool' you will need to sign up an become a member of the site, you also get to use the 'budget wizard' (Budget form) both for free!

I would wait for the outcome of the court case, expected 2-4 weeks time, but I feel the OFT will win that round.

Anyone know if the banks have anywhere else to go if this appeal fails? Can they go to European Courts and delay things even further?

Its about time that the financial institutions (banks) and the Financial Services Authority (FSA) owned up to their respective responsibilities and handed the money back that they have stolen from their customers this money is NOT yours! We are constantly told (Prime Minister) that we are living in exceptional times (referring to the credit crunch), the banks and the FSA are only wasting time by delaying the inevitable! The FSA have brought themselves into disrepute. If I'm ever told, in the future, that we (a financial institution) are regulated by the FSA I'll laugh and walk away! they are acting in the interests of themselves and the financial institution NOT the interests of the individual they are supposed to be protecting. FSA and Banks wake up and give us our money back!

It's about time the financial institutations (banks) and the Financial services authority, owed up to their responsibilities to their respective customers and accept that the bank charges are unreasonable. The banks have had it too good for too long and, the FSA has bought itself into disreptue with members of the public. If I am ever told, in the future, that we (a financial institution) are regulated by the FSA, I'll laugh and just walk away! Any insitution regulated by the FSA is not worth the paper its written on!
